ICBC Loses Appeal in $1.5 Million Judgment Case

    ICBC’s appeal against a $1.5 million judgment awarded to Clark Woods LLP client Neil MacKinnon has been dismissed by the B.C. Appeal Court. 

    The judgment, stemming from a 2018 accident, was based on substantial evidence presented by MacKinnon, including testimony from medical experts, an economist, and personal acquaintances.

    However, ICBC contested the fairness of the trial proceedings, arguing that the judge in the case made comments indicating they may have prejudged the merits of the case and expressed “negative views” about ICBC. The insurance corporation also stated that the judge made comments to MacKinnon “suggesting ways in which he could enhance his claim.”

    While the appeal court acknowledged some of the comments were problematic, they said an impartial viewer would not have come to a different conclusion.
